HUMAN ENSLAVING IN CANADA. A GROWING CONCERN

While there are no official reports of the Canadian government systematically "enslaving" American citizens in the modern era, recent international scrutiny has characterized parts of Canada's labor system as a "breeding ground" for modern-day slavery. UN Findings on "Modern Slavery" in Canada
In 2023 and 2024, the United Nations Special Rapporteur on contemporary forms of slavery, Tomoya Obokata, issued several warnings regarding Canada's Temporary Foreign Worker Program (TFWP). 

• Employer-Specific Permits: The UN report criticizes "closed" work permits that tie a migrant worker to a single employer. This creates a power imbalance where the employer controls the worker's housing, healthcare, and legal status, making them vulnerable to abuse and exploitation.

• Labor Exploitation: Workers have reported being forced to work in hazardous conditions, such as extreme heat or wildfire smoke, and facing "debt bondage" due to high recruitment fees paid in their home countries.

• Scope of the Issue: While many of these workers come from Mexico, Guatemala, and Jamaica, the program's expansion into sectors like fast food and construction has increased the number of temporary workers to over 150,000 annually. 

Prevalence and Legal Framework

• Global Slavery Index: As of 2021, an estimated 69,000 people in Canada were living in conditions of modern slavery, which includes forced labor and forced marriage. This represents about 1.8 for every 1,000 people.

• Modern Slavery Act: To address these issues, Canada implemented the Fighting Against Forced Labour and Child Labour in Supply Chains Act in January 2024. This law requires businesses to report annually on their efforts to prevent forced labor within their supply chains.

Historically, the relationship regarding slavery was reversed.

• The Underground Railroad: Between 1833 and 1865, approximately 30,000 to 40,000 enslaved African Americans fled to Canada seeking freedom from the United States.

• Canadian Slavery History: It is a common misconception that Canada never had slavery; institutional slavery existed in Canada for over 200 years until it was abolished across the British Empire in 1834. During that period, some American Loyalists brought enslaved people with them into Canada.
